TechFlow news, July 9, according to Eleanor Terrett, U.S. Senator Ron Wyden wrote to Senate leadership, requesting that any version of the "Clarity Act" submitted for floor consideration retain the provisions of the "Blockchain Regulatory Certainty Act" already passed by the Senate Banking Committee.
In the letter, Ron Wyden stated that the provision aims to codify existing federal policy, clarifying that non-custodial software developers should not be deemed money transmitters solely for publishing software, while preserving the ability of the U.S. Department of Justice and the Financial Crimes Enforcement Network to take enforcement action against illicit actors.
Reports indicate that uncertainty remains regarding whether the relevant provisions can gain support from some law enforcement agencies, and the content may still need adjustment to secure support from more Democratic senators.
